These Terms and Conditions ("Terms") govern your use of the website located at lakeelsinoretreeservices.com and your engagement with the services provided by Lake Elsinore Tree Services ("we," "us," or "our"). By using our website or requesting our services, you agree to these Terms. Please read them carefully.
By accessing our website, submitting a contact or estimate request form, or engaging us to perform services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Lake Elsinore Tree Services provides residential and commercial tree services in Lake Elsinore, CA and surrounding areas, including tree removal, tree trimming, tree pruning, stump grinding, stump removal, land clearing, emergency tree service, and commercial tree service.
We reserve the right to decline any service request at our discretion, including jobs outside our service area, jobs that present unusual safety risks, or jobs for which we are not currently equipped.
All estimates are provided free of charge and are based on an in-person assessment of the work to be performed. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
Estimates are not binding contracts. Final pricing may vary from the estimate if conditions at the job site differ materially from what was assessed (for example, if a tree is found to be more hazardous than it appeared, if site access is more difficult than anticipated, or if additional work is requested after the estimate is issued).
Any changes to the scope of work will be communicated to you before additional work proceeds. We do not perform work beyond the agreed scope without your authorization.
Service appointments are scheduled by mutual agreement. We will make every effort to honor confirmed appointment times. In the event of weather conditions that make it unsafe to perform tree work, we will contact you promptly to reschedule at the earliest available date.
If you need to cancel or reschedule an appointment, please contact us as early as possible. Cancellations made less than 24 hours before a scheduled appointment may result in a rescheduling fee at our discretion, particularly for large jobs that required advance crew scheduling.
Payment is due upon completion of work unless other arrangements have been agreed to in writing in advance. We accept payment by cash, check, and major credit cards unless otherwise specified in your service agreement.
For large or multi-day projects, we may request a deposit of up to 50% of the estimated total before work begins. The balance will be due upon satisfactory completion.
Invoices that remain unpaid beyond 30 days of the completion date may be subject to a late payment fee. We reserve the right to pursue collection of unpaid balances through available legal means.
You are responsible for ensuring that we have legal access to the property and trees on which work is to be performed. If the trees are on or near a shared property line, you are responsible for obtaining any required permission from neighboring property owners before work begins.
You are also responsible for identifying and disclosing any known underground utilities, irrigation lines, or other subsurface features in the work area before work begins. We are not liable for damage to undisclosed subsurface features.
Certain tree work may require permits from the City of Lake Elsinore or other local authorities. We will advise you when a permit appears to be required based on our experience, but ultimate responsibility for obtaining required permits rests with the property owner. We are not liable for fines or penalties resulting from work performed without a required permit when the permit requirement was not disclosed or known to us.
We stand behind the quality of our work. If you are not satisfied with the result of a service, contact us within 7 days of completion and we will work with you to address the concern.
We do not provide warranties against natural events such as storms, high winds, drought stress, disease, or other conditions beyond our control that may affect trees after our work is complete.
Our website content, including descriptions of services, is provided for informational purposes only and does not constitute professional arboricultural advice specific to your property. We recommend an in-person assessment for any concern about a specific tree.
To the fullest extent permitted by applicable law, Lake Elsinore Tree Services shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website, your reliance on information provided on our website, or the performance of our services.
Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific service giving rise to the claim.
If a dispute arises between you and Lake Elsinore Tree Services, we encourage you to contact us first to try to resolve it informally. Most concerns can be resolved through direct communication.
If informal resolution is not possible, any dispute shall be resolved through binding arbitration in Lake Elsinore, CA, under the rules of the American Arbitration Association, unless both parties agree in writing to a different process. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any legal action arising under these Terms shall be brought in the state or federal courts located in California.
We reserve the right to update or modify these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
